Having defective building work within a body corporate remedied can be a confusing process, involving a myriad of overlapping contractual, tortious, and statutory remedies.
Choosing the wrong strategy can prove to be costly.
In this seminar, our Special Counsel, Brent Turnbull will draw on his years of experience in acting for and against body corporates, builders, developers, engineers, certifiers and BSA/QBCC in order answer:
- Can a body corporate enforce the contract between the builder and the developer and how long does a body corporate have to do so?
- What other claims can a body corporate make against the builder or developer or other third parties?
- Can the Queensland Building and Construction Commission help in terms of having defects rectified, and if so, how?
- What are the pitfalls to avoid when it comes to litigating on behalf of a body corporate and in arranging for the rectification of building work within a body corporate setting?
